Terms and Conditions – Mimpi Indah Dive Resort

Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

  • Resort: Mimpi Indah Dive Resort, operated by PT Tap Takke, Indonesia.

  • Guest: any natural person or legal entity who makes a reservation or stays at the resort.

  • Agreement: any booking or reservation between the resort and the guest.

  • Package: a combination of accommodation, meals, diving activities and/or other services offered by the resort.

  • Diving activities: all forms of recreational scuba diving, snorkeling, and PADI courses offered by the resort.

  • Excursions: boat trips, day trips, or other activities outside the resort organized by or through the resort.

Article 2 – Applicability
These Terms and Conditions apply to all reservations, offers, agreements, stays, activities, and services of the resort.
Any deviations are only valid if expressly agreed in writing by the resort.

Article 3 – Reservations and Payments
A reservation is only final after written confirmation from the resort and receipt of full payment of the total amount due.

All payments must be made exclusively in Indonesian Rupiah (IDR).
Prices shown in other currencies are indicative only and have no contractual or binding value.

Partial payments or deposits are not accepted unless expressly agreed in writing by the resort.

Any additional on-site expenses (including but not limited to drinks, rental equipment, diving activities, or excursions) must be settled in Indonesian Rupiah (IDR).

Article 4 – Cancellations and Changes
Cancellation by the guest must be made in writing or by e-mail.

The following cancellation charges apply:

  • up to 60 days before arrival: 25% of the total amount

  • 59 – 30 days before arrival: 50% of the total amount

  • 29 – 15 days before arrival: 75% of the total amount

  • within 14 days before arrival or in case of no-show: 100% of the total amount

The resort reserves the right to modify or cancel reservations in case of force majeure. In such cases, amounts already paid for unused services will be refunded.

Article 5 – Stay, Check-in and Check-out
Check-in is possible from 14:00; check-out no later than 11:00, unless otherwise agreed.

Use of the bungalows and resort facilities is exclusively for registered guests.

The resort does not accommodate children under the age of 10.

Participation in diving activities is subject to international PADI standards.

Article 6 – Full Board and Meals
All stays are based on full board, unless otherwise agreed.

Full board includes daily breakfast, lunch, and dinner at the resort restaurant.

Drinks are not included unless expressly stated. Coffee, tea, and drinking water are included during meals.

The resort will take dietary requirements or allergies into account if notified in advance but cannot provide absolute guarantees.

Meals not taken are non-refundable.

Article 7 – Alcohol and Smoking
Alcoholic beverages are only served to guests aged 18 or older.

Guests are not permitted to bring or consume their own alcoholic beverages within the resort premises, bungalows, or during excursions or boat trips.

Excessive alcohol consumption or misconduct under the influence of alcohol may result in exclusion from activities or removal from the resort without any right to refund.

Smoking is only permitted in designated areas. Smoking is strictly prohibited in bungalows, the restaurant, and on boats.

Article 8 – Use of Facilities and House Rules
Guests must comply with the resort’s house rules at all times.

It is prohibited to damage, remove, or misuse resort property. Any damage caused will be charged to the guest.

Pets are not allowed unless expressly agreed in writing by the resort.

Article 9 – Diving Activities and Courses
Participation in all diving activities is entirely at the guest’s own risk.

The guest declares to be in good physical and mental health and confirms that all required medical statements, certifications, logbooks, and liability release forms are complete, accurate, and valid.

Completion and signing of all standard diving documentation, including medical questionnaires and liability release forms, is mandatory prior to participation.

A valid dive insurance covering recreational scuba diving is mandatory for participation in any diving activities.

The resort, its dive instructors, and dive guides reserve the unrestricted right, at their sole discretion, to refuse, limit, interrupt, or terminate any dive or diving activity at any time if safety, health, environmental conditions, or compliance with standards so require.

Such decisions are final and do not give rise to any right to refund or compensation.

Article 10 – Boat Trips and Excursions
Participation in boat trips and excursions is entirely at the guest’s own risk.

The resort reserves the right to cancel or modify excursions due to weather conditions, technical issues, safety considerations, or operational reasons.

If the resort cancels an excursion, any payments made for that excursion will be refunded.

If the guest does not show up or voluntarily decides not to participate, no refund will be given.

Article 11 – Liability
Participation in all activities, including accommodation, diving, snorkeling, boat trips, and excursions, is entirely at the guest’s own risk.

The guest acknowledges and accepts that staying at a remote island dive resort and participating in water-based and outdoor activities involves inherent risks, including but not limited to strong currents, waves, weather conditions, marine life, equipment failure, terrain conditions, and the actions or omissions of other guests or third parties.

The resort shall not be liable for any loss, theft, damage, injury, illness, permanent disability, or death suffered by the guest, except where such damage is caused by intent or gross negligence on the part of the resort.

To the maximum extent permitted under Indonesian law, any liability of the resort shall in all cases be limited to an amount equal to the total amount paid by the guest under the relevant agreement.

The guest agrees to indemnify and hold harmless the resort, its owners, directors, employees, instructors, guides, contractors, and agents against any claims, demands, damages, losses, liabilities, or expenses (including legal costs) brought by third parties, including but not limited to family members, insurers, or legal successors, arising out of or related to the guest’s stay or participation in activities.

The guest confirms that adequate travel, medical, diving, and accident insurance is in place for the entire duration of the stay.

Article 12 – Force Majeure
The resort is not liable for shortcomings or delays resulting from force majeure, including but not limited to natural disasters, extreme weather conditions, pandemics, power outages, governmental measures, acts of war, or other extraordinary circumstances beyond the resort’s control.

Article 13 – Complaints and Disputes
Any complaints must be reported to the resort management as soon as reasonably possible so that a solution can be sought.

All agreements, stays, activities, and services provided by the resort are governed exclusively by Indonesian law.

Any disputes shall be submitted exclusively to the competent court in Manado, North Sulawesi, Indonesia.
