Terms and Conditions – Mimpi Indah Dive Resort
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Resort: Mimpi Indah Dive Resort, operated by PT Tap Takke.
- Guest: any natural person or legal entity who makes a reservation or stays at the resort.
- Agreement: any booking or reservation between the resort and the guest.
- Package: a combination of accommodation, meals, diving activities and/or other services offered by the resort.
- Diving activities: all forms of recreational diving, snorkeling, and PADI courses offered by the resort.
- Excursions: boat trips, day trips, or other activities outside the resort organized by or through the resort.
Article 2 – Applicability
- These terms and conditions apply to all reservations, offers, agreements, and services of the resort.
- Deviations are only valid if confirmed in writing by the resort.
Article 3 – Reservations and Payments
- A reservation is only final after written confirmation from the resort and receipt of the full payment.
- Payments can be made in euros or Indonesian rupiah. If the invoice is issued in euros, payment in rupiah is possible at the exchange rate of Bank Indonesia on the day of payment.
- Any additional on-site expenses (extra drinks, rental equipment, excursions, etc.) must be settled in Indonesian rupiah.
Article 4 – Cancellations and Changes
- Cancellation by the guest must be made in writing or by e-mail.
- The following cancellation charges apply:
- up to 60 days before arrival: 25% of the total amount
- 59 – 30 days before arrival: 50% of the total amount
- 29 – 15 days before arrival: 75% of the total amount
- within 14 days before arrival or in case of no-show: 100% of the total amount
- The resort reserves the right to modify or cancel reservations in case of force majeure. In such cases, amounts already paid (for unused services) will be refunded.
Article 5 – Stay, Check-in and Check-out
- Check-in is possible from 14:00; check-out no later than 11:00, unless otherwise agreed.
- Use of the bungalows and facilities is exclusively for guests.
- Children from 10 years of age are welcome. Participation in diving activities is subject to international PADI standards.
Article 6 – Full Board and Meals
- All stays are based on full board, unless otherwise agreed.
- Full board includes daily breakfast, lunch, and dinner at the resort restaurant.
- Drinks are not included unless expressly stated. Coffee, tea, and drinking water are included during meals.
- The resort will take dietary requirements or allergies into account if notified in advance, but cannot provide absolute guarantees.
- Meals not taken are non-refundable.
Article 7 – Alcohol and Smoking
- The resort only serves alcoholic beverages to guests aged 18 or older.
- Guests are not allowed to bring or consume their own alcoholic beverages within the resort premises, bungalows, or during excursions/boat trips.
- Excessive use of alcohol and misconduct under the influence of alcohol may result in exclusion from activities or removal from the resort without refund.
- Smoking is only permitted in designated areas. Smoking is prohibited in bungalows, the restaurant, and on boats.
Article 8 – Use of Facilities and House Rules
- Guests must comply with the resort’s house rules.
- It is prohibited to damage or remove resort property. Any damage will be charged to the guest.
- Pets are not allowed unless agreed upon in writing beforehand.
Article 9 – Diving Activities and Courses
- Participation in diving activities is entirely at the guest’s own risk.
- The guest declares to be in good health and to provide the required medical and certification documents (if applicable).
- The resort and its instructors reserve the right to exclude guests from participation if safety is at risk.
- A valid dive insurance is mandatory for participation in diving activities.
Article 10 – Boat Trips and Excursions
- Participation in boat trips and excursions is at the guest’s own risk.
- The resort reserves the right to cancel or modify planned excursions due to weather conditions, technical issues, or safety reasons.
- If the resort cancels an excursion, any payments made for that excursion will be fully refunded.
- If the guest does not show up or voluntarily decides not to participate, no refund will be given.
Article 11 – Liability
- Staying at the resort and participating in activities is at the guest’s own risk.
- The resort is not liable for:
- loss, theft, or damage to personal belongings;
- injury or accidents during the stay or activities, unless caused by intent or gross negligence on the part of the resort.
- The guest is responsible for taking out travel, diving, and cancellation insurance.
Article 12 – Force Majeure
The resort is not liable for shortcomings resulting from force majeure, including but not limited to natural disasters, extreme weather conditions, pandemics, power outages, acts of war, or other extraordinary circumstances.
Article 13 – Complaints and Disputes
- Any complaints must be reported to the management as soon as possible so that a solution can be sought.
- If a dispute cannot be resolved amicably, only Indonesian law applies to the stay and related services.
- Disputes shall be submitted exclusively to the competent court in Manado, North Sulawesi.
Article 14 – Bookings from the Netherlands and the EU
- For reservations made directly through our website or through our Dutch entity, the agreement is deemed to be concluded in the Netherlands. Dutch law and EU consumer regulations apply to the booking process, invoicing, and payment.
- Bookings for travel and accommodation arrangements are explicitly excluded from the statutory EU right of withdrawal (14-day cooling-off period), in accordance with Article 6:230p of the Dutch Civil Code.
- All amounts invoiced from the Netherlands are in euros and include VAT where applicable.
- The stay itself, as well as the use of resort facilities and participation in activities, is governed by Indonesian law and falls under the jurisdiction of the competent court in Manado, North Sulawesi, as described in Article 13.
- In the event of a conflict between Dutch/EU consumer protection rights and these Terms and Conditions, Dutch/EU consumer protection shall prevail for the booking process.
